Information on the protection of your personal data, including your rights.

We have divided the Policy into three parts:

  1. explanation of terms used in the Policy, information about our contact details and your rights;
  2. detailed information on the processing of your personal data; we have provided information separately for each form you can fill out on our Website,
  3. information about cookies.

Part I – General Provisions

Controller

  1. We, Linesa Investments sp. z o.o. with its registered office in Łódź, are the Controller of your personal data. In the remainder of this Privacy Policy, we refer to ourselves in the first person or as “Controller” or “We”.
  2. Our registration files are maintained by the District Court for Łódź – Śródmieście in Łódź, XX Commercial Division of the National Court Register (KRS), under KRS number 654723, NIP 5223080323, REGON 366173547. The share capital of the Controller is PLN 5,000.00. Our files contain the most important information about us, e.g., financial statements or our company’s articles of association.

Terms used in the Privacy Policy

If you notice one of the following terms capitalized in the remainder of our Privacy Policy, you should understand it according to the definitions below:
  1. “Website” – the website whose main page is located at https://nowatkalnia.pl/,
  2. “Policy” – means this document, i.e., the privacy policy you are reading,
  3. “GDPR” – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. The text of the GDPR can be found here.

Protection of personal data

  1. All personal data that you provide on the Website or that we collect about you during your use of the Website are processed by us as the Controller in accordance with the GDPR.
  2. We apply technical measures required by current personal data protection regulations to prevent unauthorized acquisition and modification of personal data transmitted electronically, i.e., within our Website.

Your rights regarding personal data

  1. We process your personal data, therefore:
    1. you have the right to access your personal data,
    2. you can rectify them,
    3. you can request the erasure of your personal data, when permitted by the GDPR,
    4. you have the right to restrict processing, to the extent specified in the GDPR.
  2. In the second part of the policy, you will find information about additional rights. For some forms, you will have additional options.

Right to object

  1. After providing us with your personal data, you can exercise your right to object. You have this right in two situations when we process your personal data:
    1. for direct marketing purposes; you do not need to justify such an objection
    2. based on our other legitimate interests; such an objection requires justification based on your particular situation. Please tell us why we should not process your data.

Complaint to the President of the Personal Data Protection Office

If you believe that we are processing your personal data unlawfully, you can lodge a complaint with the supervisory authority. In Poland, this is the President of the Personal Data Protection Office. Here is a link to the President’s website.

Anonymity

You cannot use the services available on the Website anonymously.

Part II – information related to the processing of your personal data in individual forms and during contact with us

Contacting us via contact form, email, or phone number

If you use these options on our Website, please note the following:

  1. Why do we need your data, i.e., for what purpose do we process it?
    1. to respond to your message and resolve the matter you presented,
    2. for marketing purposes consisting of: sending a request for consent to send commercial offers, promotions of our goods and services, in particular sending offers for residential units located in the Nowa Tkalnia estate in Łódź, and for promoting ourselves on the Website and on other websites where we display advertisements.
  2. What are your rights?
    We have described them in § 4 and 5 of the Policy.
  3. Do you have to provide us with your data?
    It is voluntary. Without providing your contact details, we may not be able to resolve the matter you presented.
  4. What is the legal basis for processing your data?
    1. Art. 6 sec. 1 lit. f of the GDPR, i.e., our legitimate interest;
    2. If you consent to receive marketing communications via email or SMS, the legal basis will also be Art. 10 of the Act on the Provision of Electronic Services and Art. 172 of the Telecommunications Law. Remember that you can always withdraw your consent. If you wish to do so, please contact us.
    3. If you consent to receive marketing communications via voice telephone calls, the legal basis will be Art. 172 of the Telecommunications Law. Remember that you can always withdraw your consent. If you wish to do so, please contact us.
  5. What is our legitimate interest?
    Resolving the matter you presented, responding to your message, and conducting our marketing, as described in point a. 2) of this paragraph.
  6. To whom will we transfer your data?
    1. To providers of tools for traffic analytics and marketing on our website,
    2. To entities providing hosting (storage) for the Website or personal data for us,
    3. To the entity providing services related to the operation and maintenance of the CRM program.
  7. Will your personal data be transferred outside the European Economic Area?

    Yes, to Australia, based on Council Decision 2008/651/JHA/CFSP of 30 June 2008 on the signing, on behalf of the European Union, of the Agreement between the European Union and Australia on the processing and transfer of Passenger Name Record (PNR) data by air carriers to the Australian Customs Service. You have the right to receive a copy of your data transferred there.

  8. How long will we process your data?
    For the period:
    1. necessary to resolve the matter you presented. Depending on its nature, also for the time necessary to demonstrate that we have resolved it, i.e., for the limitation period for claims.
    2. of conducting marketing activities by us or until you object to further processing of data for marketing purposes.

What are cookies and why do we use them

  2. We store cookies on your computer, phone, or tablet, and then access the information contained therein for the following purposes:
    1. marketing purposes consisting of collecting information about your activities on the Website; thanks to this, we adapt its content to your interests and needs, for example, we generate personalized content for you; we also adapt advertisements displayed to you on other websites to what you viewed on our Website and to your interests, for example, we can display an advertisement for a product you viewed on our Website on a news website,
    2. managing visit counters, using polls, remembering the selected language version,

Impact of browser settings changes on Website usage
